DoJ to review Wire Act’s applicability on Lotteries
A new memo signed by Deputy Attorney General Rod Rosenstein of Department of Justice (DoJ) was issued and filed in the New Hampshire litigation on April 8 pursuant to which the DOJ
(i) acknowledges that its recent opinion did not address whether the Wire Act applies to state lotteries and their vendors,
(ii) states that the DOJ is now considering the issue,
(iii) direct DOJ prosecutors not to take action with respect to state lotteries or their vendors operating in compliance with state law until DOJ concludes its review,
(iv) states that if the DOJ does conclude that the Wire Act applies to state lotteries and their vendors DOJ attorneys should provide an additional 90 days forbearance from the date of the DOJ’s public announcement of its conclusion.
